Terms of Use (incorporating Privacy
Policy)
Applicability
These Terms of Use apply to your use of and
access to the internet site belonging to Financial Payment
Systems Limited (“FPS”) and whose internet address
is www.efps.com (”the FPS Site”).
FPS is incorporated in Jersey, Channel Islands
with company registration number 91540 and has its registered
office at 2 Bond Street, St Helier, Jersey, Channel Islands
JE2 3NP.
Your use of the FPS Site is subject to and
governed by these Terms of Use which apply to you and to FPS.
By accessing the site you are deemed to have accepted these
Terms of Use. If you do not agree to the Terms of Use, you
should cease your access to the FPS Site.
Trademarks, logos and other marks
The FPS Site may from time to time feature
logos, trademarks and service marks that are the property
of or are licensed to FPS and in some cases (which will be
identified as such where applicable) third parties. The use
or display of any of them in any manner without the prior
written permission of the applicable rights owner is prohibited.
Use of materials from the FPS Site
The FPS Site and its content is and will
remain the absolute property of FPS or (in the case of certain
trademarks, logos and marks) is content which FPS is licenced
to use. Your use of the site is therefore limited to access
to the pages comprising the FPS Site and extends to printing
copies of the material for non-commercial purposes. Your use
does not extend to and modification or distribution of any
material from the FPS Site in any manner.
Links
Where the FPS Site includes links to other
sites operated by third parties, FPS is not responsible for
the content or accuracy of those sites, and accepts no responsibility
for them or their content.
Access and conduct
You agree that your use of the FPS Site will
be exercised in a lawful and responsible manner. In particular
you agree not to participate in any “denial-of-service”
or similar disruptive attack against the FPS Site.
Privacy policy
FPS does not collect store or process your
personal information by virtue only of your use of the FPS
Site. If you submit your personal information to us voluntarily
in some form of communication, we will store it but will not
divulge it or sell it to any third party (here meaning any
person outside the FPS group) unless we are required to do
so by law or to comply with the rules of any stock exchange
on which we are listed. FPS is registered under the Data Protection
(Jersey) Law 2005.
Disclaimers
FPS does not warrant that use of the FPS
Site will be uninterrupted or error free and your use of the
FPS Site is therefore undertaken at your own risk. In particular
FPS disclaims any warranty, either express or implied, that
the FPS Site is or will be virus-free.
Whilst every effort is made to ensure the
accuracy of information comprised in the FPS Site, no warranty
as to its accuracy is given, and you should not therefore
rely upon its accuracy without further verification.
Limitation of liability
Neither FPS nor any group or related company
of FPS nor any third party content providers accepts liability
arising from access to, use of or inability to access or use
the FPS Site, and in particular shall not be liable for any
direct, consequential, indirect, incidental, special, punitive
or any other damages relating thereto. Such limitation of
liability shall apply to the fullest extent permissible in
law.
Governing law
Your access to the FPS Site and these Terms
of Use is governed by the laws of the States of Jersey. You
are responsible for ensuring you comply with the laws of your
jurisdiction from where you have accessed the FPS Site.
Changes to Terms of Use
From time to time FPS may need to change
these Terms of Use and in such cases FPS will post such changes
on the FPS Site.
